Declan Gourley is an attorney licensed to practice law in New Jersey, New York and the U.S. District Court of New Jersey.
Declan is a Partner at Lois LLC where he concentrates on New York Workers’ Compensation Defense; representing insurance companies and self-insured employers before the New York Workers’ Compensation Board. He is based out of the firm’s Paramus office.
He regularly appears at all New York Workers’ Compensation Board hearing points south of Albany including: Staten Island, White Plains, Hauppauge, Brooklyn, Manhattan, Queens (Jamaica), Poughkeepsie, Newburgh (New Windsor), Hudson, Menands and New City.
He is responsible for drafting memorandum of law in support of positions at the hearing level and drafting legal briefs to appeal decisions made by Judges and the Board Panel.
Declan completes depositions of both the carrier’s IMEs and the claimant’s treating physicians. He is skilled in presenting the testimony of independent medical examiners and cross-examining treating physicians.
In addition to his involvement in all aspects of the litigation process, Declan also offers settlement analysis and negotiates Section 32 settlements to close both the indemnity and medical portions of workers’ compensation claims.
Prior to joining Lois LLC, Declan worked for an insurance defense firm where he focused on workers’ compensation matters. Declan previously worked for a disability law firm representing claimants applying for Social Security Disability Benefits and various disability retirement pension programs for New Jersey state employees. Declan authored a book titled “Applying for Social Security Disability (SSD) Benefits or Supplemental Security Income (SSI)? 33 Commonly Asked Questions Answered.”
Declan also has experience in assisting former National Football League (NFL) Players apply for disability retirement benefits through the Bert Bell/Pete Rozelle NFL Player Retirement Plan.
